The NC Criminal Justice Education & Training Standards Commission alleged two violations against client: that client-licensee committed a class b misdemeanor, as defined by the Commission regulations, and lacking good moral character. Landon White represented client-licensee before the Probable Cause Committee at a hearing wherein the PCC found probable cause for a class B misdemeanor but did not find probable cause for lacking good moral character. The PCC recommended a suspension of not less than five years. Licensee appealed the administrative suspension to the NC Office of Administrative Hearings. An administrative law judge recommended the suspension be stayed for three years on the condition that licensee be placed on probation for three years. When the decision of the administrative law judge went before the full Commission for final rehearing, the Commission did not find sufficient evidence that licensee committed a class B misdemeanor. Client was cleared of all alleged violations and maintained their law enforcement Certification.

Client-licensee received notice of violations of Respiratory Care Practice Act for engaging in health care practices that are determined to be hazardous to public health, safety, or welfare and aiding and abetting another person in violation of the Act. Licensee retained attorney Landon White during investigation before licensee sat for an interview with investigators. Landon White Law was able to establish that licensee had not committed any violations of the Respiratory Care Practice Act. The Board dismissed the notice of violations.

Result: Closure of Investigation with No Action Taken

Client-licensee investigated by the NC Health Care Personnel Registry for fraud related to discrepancies in notes on her charts. Licensee retained Landon White Law for the investigation before licensee sat for an interview with investigators. Landon White Law was able to show perceived discrepancies in the charts were de minimus and not intended to deceive. CNA licensee had performed duties as charted. Licensee was cleared of wrongdoing and no action taken by the Registry.

Client-licensee retained Landon White Law for representation making self-report of DWI charge within 30 days of the arrest as required by the Nursing Practice Act. By coincidence, licensee also needed to renew their license within the same time period. Attorney Landon White assisted with the drafting, disclosure, and correspondence with the Board, which accepted the self-report with no further action and approved the renewal application.

Client-licensee investigated by employer, a health care facility, for HIPAA violations and aiding and abetting Health Insurance Portability Accountability Act (HIPAA)violations. Licensee retained Landon White Law as soon as notified by human resources. Attorney Landon White was able to short circuit the investigation through conversations with the attorney for the health care facility. No Board action taken.

Client-licensee retained Landon White Law to assist with drafting disclosures of prior convictions on the application for licensure. Attorney Landon White drafted responses and assisted with the submission. After submission, he coordinated with the Board as it reviewed licensee’s application. Licensee’s application was approved without further interview or investigation.

Client-licensee charged with embezzlement from company where client served as controller. Attorney Landon White negotiated a Consent Order wherein licensee voluntarily surrendered their CPA license instead of having it revoked. Further, attorney Landon White timed the surrender to take place before a conviction was entered against the licensee. Thus, the Consent Order did not include a conviction as a finding of fact. The omission of this finding off act allowed licensee to reapply for licensure in 5 years.

Client-licensee submitted an application for licensure which was initially denied by the Board due to a criminal conviction for federal mortgage fraud and time in federal prison. Licensee appealed the denial for review by the full Board and retained Landon White Law. Attorney Landon White put on evidence in favor of licensee and argued for licensee’s fitness to practice the profession. The Board approved licensee’s application following the hearing.

Client-licensee investigated for broker activities related to finding a tenant for their client. After disagreement with the landlord, the tenant complained to the NC REC and claimed that the licensee was acting as property manager and had defrauded tenant. Licensee retained Landon White Law firm during the investigation and before submitting a written response to the NC REC investigator. Attorney Landon White drafted a written response with exhibits exculpating licensee from any violations. The NC REC closed its investigation with no action taken against licensee.
